Obama expected to sign TSCA

Now that both chambers of Congress have approved the first update to regulating toxic chemicals in 26 years, President Obama is expected to sign the Toxic Substances Control Act (TSCA) soon.

Unlike recent regulations pushed out by the administration, NSSGA supported the TSCA modernisation bill and the final measure includes language that was suggested by the association. The legalisation instructs the EPA to start a new risk review process, and requires the agency to give priority to substances that persist and accumulate in humans. Based on the EPA’s risk assessment for a given chemical, the agency is required to issue risk management rules. The new requirements can include anything from new labels to an outright ban. NSSGA will actively oppose any attempt by the EPA to regulate common rock dust particles.
