Amendment proposed to WOTUS rule

A proposed rule on Waters of the United States (WOTUS) that originates from the Army Corps of Engineers and the Environmental Protection Agency is expected to be finalised this spring and could be fully implemented by October. The rule would impact the operations of aggregates operators seeking to expand operations by increase permitting and mitigation costs. It has been opposed by both the Portland Cement Association and the National Stone, Sand and Gravel Association (NSSGA).
On 23 March, Sen. John Barrasso, R-Wyo, offered an amendment to the Senate budget resolution that would limit Clean Water Act (CWA) jurisdiction and exclude groundwater, stormwater, stormwater systems, irrigation systems, wastewater systems, isolated ponds, ditches and puddles.
NSSGA is working with its Waters Advocacy Coalition partners to build support for Barrasso’s amendment. Though budget resolutions do not have the force of law, they are clear indicators of Congress’ intent on key issues.
