Army Corps does not back WOTUS rule

The US National Stone, Sand and Gravel Association (NSSGA) reports on the Army Corps of Engineers reservations over the Waters of the US (WOTUS) rule. When the revisions to the legislation were first announced, they were said to come from both the Army Corps of Engineers and the Environmental Protection Agency (EPA). However, private documents have since shown that the Corps disagrees with multiple legal, scientific and technical aspects of the EPA proposal. The Corps denies that it was part of analysis to reach the conclusions described in the EPA’s proposals and questions how it will be able to enforce a rule that it does not fully support or understand.

Pam Whitted, NSSGA Senior Vice President of Government and Regulatory Affairs, said: “If the Army Corps of Engineers has issues with the rule’s lack of clarity and how to implement WOTUS, then it should be scrapped.”

The Senate Environment and Public Works Committee is examining the rule.
